吉美小吃店

傍晚烤了幾個昨天買的紫色蕃薯(別名似乎是芋頭蕃薯),一個給君瑋,自己吃了兩個。雖有老王賣瓜的嫌疑,但我還是得誠實地說,真的還滿好吃的!應該是材料本身就還不錯,滿甜的,所以放進烤箱,300度,烤個四十分鐘就熱騰騰地鬆軟好吃了。

到了八點左右,該是吃晚餐的時候了,再不去吃,店都要關門了。今晚來到了國北師(雖然已改名國立台北教育大學,還是習慣這樣稱呼)對面的巷子,一看覺得不大妙,習慣吃的那幾家店都已經關了或今天根本沒開。眼睛喵到了路邊的一家「吉美小吃店」,看起來燈光明亮,店內顧客好像也不少,抱著姑且一試的心態就衝了。外面看來有各式炒麵、炒飯,進了店內才發現,其實除此之外,還有許多好料的,尤其是烤魚及其他油炸類的,感覺起來其實是間平價熱炒店,頓時覺得,挺適合喝啤酒聊天的。
今天三個人各吃了羊肉炒麵當主食,又加點了炒高麗菜心、九層塔煎蛋及虱目魚肚湯一起分食(在台北很少有機會吃到虱目魚相關料理)。一人總共花了將近130元。各道菜味道都還不錯,價格也算實惠,整體而言算是還可以再來的店。

Reflections on Government Regulation of Street Artists

I came across the following news about street artists tonight.

It looks like a piece of ordinary entertainment news that just want to make you laugh at first sight. But after reading it, questions came into my mind: Why does government regulate street artists? How are the regulation mode and specific regulations? Is it legitimate for government to regulate street artists by issuing permits? Are government permits required for a street artist to perform at public spaces?

I checked out the regulations made by different city/county governments in Taiwan. As for the specific regulations, there are basically three types, typified respectively by regulations made by Taipei City Government, Taichung City Government and Kaohsiung City Government. I can not show those regulations of each city government due to some technical problems. This post is a reminder for me to think over this issue in the next few days.

想成街頭藝人 先考證照再圓夢想

不只創意市集,可以發揮想像力。這幾年,在台北街頭,也常常可以看到街頭藝人表演,他們可是得先考上證照,才能在街頭表演創意,完成自己的夢想。

民族舞蹈跳得熱情,一旁還有小丑折氣球,吸引小朋友注意。

這裡,宛如表演嘉年華會,想要秀自己,找舞台的人都可以來大展身手。

他,是聽障人士,用默劇表演跟觀眾溝通,來參加街頭藝人考證,希望透過藝術能帶給人們歡樂。

想要找到表演舞台的,還有這群剪紙媽媽,一支剪刀一張紙,只想推廣剪紙樂趣。

不分年女老少,想當街頭藝人的人真不少,有年輕人一人獨演。也有一群人一起來。

評審一攤一攤看,看得很入神,熱情民眾也參與評分,街頭藝人考照已經進入第三年,目前有四百多人拿到證照,主辦單位台北市文化局也鼓勵更多想秀敢秀的人來報名,讓台北街頭充滿多元的藝術氣息。

From 公館 to 聖人瀑布

On Thursday night, Charlie told me that there was coverage of the entertainment show host, 聶雲, about his hobby to bike onto Mt. Yang-Ming in the latest issue of 壹週刊. I got excited about the whole thing. After I met Dad at his hotel, I bought a 壹週刊 and check it out immediately. I was really encouraged by the news report and decided to take my first night biking and go up to Mt .Yang-Ming. I was too naive for all of this but I did not know that. Biking at night in the riverside cycling lanes are not so dangerous or horrible as you might think. The illumination was good around the entrance areas of every riverside park but as you go farther from the entrance areas of these parks, the illumination gets worse. So I have to concentrate myself on everything on and beside the cycling lane. But there are also a few cyclists on the lane when I did my cycling so basically I felt safe though a bit nervous. Riding via the riverside cycling lanes to Mt. Yang-Ming from NTU where I live is not a good idea. The distance is much longer than riding through the city downtown and it took me much more time too. I started my biking at nearly 22:00 and got to Sun Yat-Sen Soccer Stadium at about 23:15. So I gave up my plan to Mt. Yang-Ming and began my way back home. I dropped by my dear friend, Mr. Lai, who lives in the vicinity of 永康街 and got special gifts from him. We bought salty fried chicken and some fried snacks and shared the snacks while chatting at Yong-Kang Park. It was a lovely night.

I just could not forget my plan and repress my desire to bike up to Mt. Yang-Ming so I called my friend, Charlie, about our plan to bike up to Mt. Yang-Ming this Saturday morning. It is, however, a pity that it rained this early morning and our biking plan was delayed for realization. But we're also quite lucky because it stopped raining at around 10:00 and we restarted our biking plan. I started off at 10:30 and met Charlie at the park near his home at 11:20. Before we started our trip to Mt. Yang-Ming, he bought drinks at 7-Eleven and we shared some bananas. Our biking plan was to go up to Chinese Culture University via the route with its entrance beside Ming-De Amusement Park. This biking route made me really excited. However, we failed to realize it eventually. Charlie didn't feel so good today and it was near noon, really hot and humid when we were biking up via 至善路, so Charlie got tired quickly and requested for rest several times. In response to this situation, we modified our plan and decided to bike up to 聖人瀑布 today, no more or he would be dying.

We arrived at the scenic spot 聖人瀑布 at about 13:30, although we didn't really go to see the waterfalls. Initially, I wanted to go up further but I got 落鏈 just when I started to go up further within 100 meters so I stopped and we fixed the problem by teamwork with Charlie. It's a nice trip although we are still not be able to realize my dream to bike up to Mt. Yang-Ming. To go up Mt. Yang-Ming is my goal next week.

A Setback for Free Culture!

This is ridiculous!
The judgment of the district court does not strike a good balance between fair use and proprietary rights.

Let me post this news here in case I forget it in a few days. I will write my opinions about this whole thing later.

判刑首例部落格貼歌 被判5個月

〔記者劉志原、王珮華/台北報導〕全國百萬部落客注意,只要在部落格裡面放音樂檔,即使只是當成背景音樂或和網友分享、不提供下載也會吃上官司!

可易科罰金15萬 緩刑3年

一位二十二歲的孫姓高職生在無名網站自己的部落格中放音樂,被台北地院依違反著作權法判刑五個月,可易科罰金台幣十五萬,法官認為他沒有營利行為也無前科,予緩刑三年,這是因為在部落格放音樂遭判刑首例。

孫姓高職生以「Wlance」為名,在網路相簿「無名小站」上的部落格寫網誌,九十三年起,他陸續將歌手陳綺貞「旅行的意義」、劉德華「相思成災」及羅志祥「自我催眠」等三百九十八首流行歌曲上傳放在部落格中供網友試聽。

由於部落格內歌曲豐富,孫某的部落格人氣指數長紅,卻也引來國際唱片業交流基金會(IFPI)注意。

IFPI進入孫某部落格網誌後,發現高達三百餘首歌曲遭盜用,損及滾石、上華等唱片業者著作權利,報警處理,九十五年十二月廿六日下午,警方大陣仗前往孫某家中搜索,家人還以為他犯了什麼重罪,最後才知是違反著作權法。

無名小站昨日表示,在提供網友上傳空間時,就提醒使用者勿上傳違法檔案,刑責自負,也與IFPI密切配合,只要IFPI要求拉下違法檔案,無名小站都會刪除。

無名小站:早提醒自負刑責

無名小站產品經理兼發言人林弘全表示,該公司網誌與相簿空間,對使用者上傳的檔案格式設限不多,網友可以自由上傳mp3、swf等影音格式,但上傳的時候,系統已經提醒「勿上傳違法檔案,刑責自負」。

不過,無名小站部落格數量達二百八十萬個,Yahoo!奇摩部落格也有二百萬個,數量驚人,Yahoo!奇摩表示,儘管目前Yahoo!奇摩部落格並未提 供網友上傳影音檔案,但網友透過內嵌的方式,連到外部的音樂檔案,依然可以在Yahoo!部落格分享音樂,難以在事前限制網友上傳違反著作權的影音檔,只 能提醒網友小心。


Pixnet創辦人建議 先勸導再開罰

〔記者袁世忠/台北報導〕部落格使用未授權音樂吃上官司,部落客、業者與法律專家都認為,最好的自保方式,就是自己創作音樂。

「絕對不要用有版權爭議的東西在部落格上!」提供相簿、部落格服務的Pixnet創辦人曾皇霖指出,過去也有網友因為使用未授權的音樂而被告,不過若數量不多,加上立刻撤除道歉,多數著作權人都不會太追究。他也建議,執法單位或許可以先進行勸導,不改善才開罰。

知名部落格格主「狗貓」強調,不論是網路上抓的,或是花錢買了CD、自己用軟體轉成mp3後使用在部落格上,被控侵權的案例還真不少。

網友若真想使用背景音樂,例如Xuite等部落格平台,會提供一些經過授權的音樂;許多唱片業者為了宣傳,也會在官方網站上授權主打歌曲的片段供網友連結使用,比較安全。

資策會科技法律中心主任王郁琦表示,現在很多年輕人誤以為當成背景音樂又沒提供下載,不算侵權,事實上,所有利用都必須經過著作權人的授權同意,除非是演 奏年代久遠的古典音樂,或是自己創作的作品。他也提醒網友,即使是付費下載的音樂,也要注意合約上的授權內容,以免觸法。


上月 個遭搜索網站 無名小站最多

〔記者段子薇、王佩華/台北報導〕不要以為高職生在部落格貼音樂被判刑只是特例,IFPI表示,將持續舉發不法的網站,希望廣大的部落格使用者,要尊重智慧財產權。

IFPI四月份公布的重大案件取締報告,遭搜索的四十四個網站中,無名小站佔了十七個,Yahoo!奇摩也有十個,Hinet Xuite六個,而Sina部落格則有一個,只是孫姓高職生是第一個被判刑的侵權部落客而已。

IFPI秘書長李瑞斌說:「其實從去年到今年,我們平均每個月舉發的案例都有二、三十件,我們一直持續在做,只是大家沒報導而已!」

他強調,重點不在被舉發的人是高中生還是平民老百姓,而是每個人都不應該分享不屬於自己的東西,「自己的東西可以跟別人分享,不是你的東西怎麼可以分享呢?那應該叫做分贓吧!」

IFPI認定,只要在部落格或MSN分享音樂,就是把偷來的東西跟別人分贓,等於觸犯著作權法,今後仍會繼續舉發下去。

My new blog, My first post!

網路網網相連的特性,這對我這種很容易被新奇的事物吸引的人來說,只要一連上網路,常常接著就是一兩個小時過去了。本來在讀一篇AAI上面的一篇文章,結果在註腳裡面發現了First Monday這個網路雜誌,很好奇地上網瀏覽了一下,接著又連到了Issues Crawler,結果為了這個Issues Crawler到底如何運作,又只好註冊個帳號,只好來重開我這個好久以前加入,卻不曾貼過文章的blog。也好,為我這亂無頭緒的論文寫作過程留下些紀錄XD
